การทำสัญญาค้ำประกันสำหรับสมัครงาน
สวัสดีค่ะ เนื่องจากน้องสาวไปสมัครงานที่บริษัทแห่งหนึ่ง ตอนนี้บริษัทรับเข้าทำงานแล้วแต่ต้องมีผู้ค้ำประกันมาเซ็นต์สัญญาค้ำประกัน สิ่งที่ระบุในเอกสารก็คือต้องเตรียม
1. สำเนาบัตรประชาชนผู้ค้ำประกัน
2. หนังสือรับรองเงินเดือนหรือสลิปเงินเดือนของผู้ค้ำประกัน
3. สัญญาค้ำประกันที่บริษัทให้น้องสาวนำมาให้ผู้ค้ำประกันเซ็นต์ ซึ่งคือดิฉันเอง ซึ่งหนังสือฉบับนี้มีเนื้อหาตอนนึงว่า "ข้อ5 ผู้ค้ำประกันยินยอมสละสิทธิ์ในการที่จะยกข้อต่อสู้ใดๆขึ้นต่อสู้กับบริษัทฯทั้งสิ้น หรือเรียกร้องให้บริษัทดำเนินคดีและบังคับชำระหนี้จาก น.ส. .... ก่อนแต่ประการใด"
เนื้อหาในข้อ1-4มีใจความดังนี้
"หาก น.ส. ... ไม่ปฏิบัติตามข้อตกลงของบริษัท .... หากผู้ค้ำประกันยังมิชดเชยค่าเสียหายแก่บริษัทฯตามคำเรียกร้อง ผู้ค้ำประกันยินยอมเสียดอกเบี้ยในอัตราร้อยละ15ต่อปีของเงินต้นที่เรียกร้องไป จนกว่าผู้ค้ำประกันจะชดใช้ค่าเสียหายให้แก่บริษัทฯเสร็จสิ้น" ... "ผู้ค้ำประกัน ยอมรับผิดในฐานะลูกหนี้ร่วมกับ น.ส. ... "
ซึ่งดิฉันไม่เคยเห็นค่ะ แต่มันเหมือนกับตอนดิฉันสมัครบัตรเครดิต และต้องใช้สลิปเงินเดือน และดิฉันก็ไม่ต้องมีผู้ค้ำประกันตอนดิฉันสมัครงานด้วย
รบกวนขอคำปรึกษาจากอาจารย์นะคะเพราะเพื่อนๆก็ไม่เคยเจอแบบนี้เหมือนกันค่ะ

ไม่ทราบว่าน้องของคุณ สมัครเข้าทำงานในตำแหน่ง ถ้าดูแล้วน่าจะเป็นเรื่องที่เกี่ยวข้องกับเงินนะ เพราะตาม พรบ.คุ้มครอง 2551 กล่าวว่า
มาตรา ๑๐ ภายใต้บังคัมาตรา ๕๑ วรรคหนึ่ง ห้ามมิให้นายจ้างเรียกหรือรับหลักประกันการทำงานหรือหลักประกันความเสียหายในการทำงาน ไม่ว่าจะเป็นเงิน ทรัพย์สินอื่นหรือการค้ำประกันด้วยบุคคลจากลูกจ้าง เว้นแต่ลักษณะหรือสภาพของงานที่ทำนั้นลูกจ้างต้องรับผิดชอบเกี่ยวกับการเงิน
แต่ถ้าทำงานไม่เกี่ยวกับการเงิน ตามความเห็นของอาจารย์ ไม่น่าจะทำได้ครับ
